Terms of Service

1. Acceptance

Whalecuts is a service operated by Travis Worthing (“we”, “us”). By accessing or using Whalecuts (the “Service”) you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service

The Service lets you sign in with Twitch, search and transcribe your Twitch VODs, assemble and edit clips, render them to video, and optionally publish those renders to platforms you connect (such as YouTube and TikTok). The Service is provided as-is and may change, and features may be added or removed, over time.

3. Your account

You access the Service using your Twitch account and must meet the minimum age and eligibility requirements of Twitch and any other platform you connect. You are responsible for activity that occurs under your account.

4. Your content

The Service lets you archive, transcribe, and edit publicly available Twitch VODs, which may include streams published by creators other than you. The transcripts, clips, edits, and renders you create are yours (“Your Content”), and we claim no ownership of them. You grant us the limited right to store, process, and transmit the VODs you archive and Your Content solely to operate the Service for you — transcribing, rendering, and, when you explicitly choose to publish, delivering a render to the connected platform you select.

You are responsible for the content you process and publish. You represent that you either own it or have a lawful basis to use it — including, where applicable, fair use or fair dealing for purposes such as commentary, criticism, or news reporting — that you provide appropriate attribution where due, and that your use does not violate any third party’s rights or the terms of any platform involved (including Twitch and the platform you publish to).

5. Acceptable use

You agree not to use the Service to:

  • infringe intellectual-property, privacy, or other rights, or process content you do not have the rights to;
  • upload or publish unlawful, harmful, harassing, or deceptive content;
  • attempt to disrupt, reverse-engineer, overload, or gain unauthorized access to the Service or its infrastructure; or
  • violate the terms of any connected platform (Twitch, YouTube, TikTok, or others).

6. Third-party platforms

When you connect a platform such as YouTube or TikTok, your use of that platform remains subject to its own terms and policies, and the platform may change or revoke access independently of us. We are not responsible for the availability or behavior of third-party platforms. How we handle the data involved is described in our Privacy Policy.

7. No warranty

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any render or publish will succeed.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service.

9. Termination

You may stop using the Service at any time and request deletion of your account as described in the Privacy Policy. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.

10. Changes to these terms

We may update these Terms as the Service evolves. Material changes will be reflected by a new effective date at the top of this page; continued use after a change constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
